Delaware does run a state controlled-substances registration separate from DEA — 16 Del. C. § 4732(a) requires biennial registration by 'any pharmacy, distributor, manufacturer, practitioner ... researcher or other controlled substance registrant who has or proposes to engage in activities accordingly within this State', issued by the Secretary of State through the Controlled Substance Advisory Committee. What could not be established is whether an EMS agency is one of those registrant classes. The Division of Professional Regulation enumerates its categories twice and EMS appears in neither: practitioners are 'physicians, physician assistants, advanced practice registered nurses, podiatrists, dentists, optometrists, and veterinarians' and facilities are 'pharmacies, distributors, manufacturers, hospitals, clinics, researchers, laboratories and provider pharmacies'. The facility CSR page and the Committee's forms page carry no ambulance, EMS, or paramedic application, and 16 Del. C. ch. 98 (Paramedic Services) does not use the phrase 'controlled substance' anywhere. Recorded ambiguous rather than false because the statutory catch-all 'other controlled substance registrant' could be read to reach an EMS agency and no Delaware authority says either way.
