Partly supported

The word 'protocol' does not appear in the operative section; it sits in the definition, SDCL 36-4B-1(8), which reads '"Indirect control," the establishment and implementation of guidelines, policies, and protocols approved by a physician, physician assistant, or nurse practitioner, licensed in this state' (verified 2026-08-13). Hence partial. On the drug side, SDCL 36-4B-17(4) lets a paramedic administer medications approved by the medical board, and the board's own scope-of-practice guide puts fentanyl, ketamine, midazolam and morphine on the paramedic list (https://sdbmoe.gov/media/d0allzgt/ems-scope-of-practice-guide.pdf). One South Dakota oddity worth carrying: where an ambulance service holds a hardship exemption, §36-4B-15 lets a physician assistant or nurse practitioner supply that supervision instead of a physician.

Confidence is low because the same page contains an unresolved tension and South Dakota has not published an answer to it. The page states that 'A South Dakota State Controlled Substance Registration number is now required before obtaining a DEA Registration number' and that providers must complete the state application before the DEA will issue a new number. Since the DEA's 2026-03-09 rule created an EMS Agency registration category that most non-hospital-based South Dakota services now need, one reading is that those services must first obtain a state registration — but the registrant classes quoted here, which are the state's own answer to 'Who Needs a SD Controlled Substance Registration', include no ambulance or EMS entry.
